2. INFORMATION WE COLLECT

Depending on your relationship with us (candidate or corporate client), we may collect:

a) Candidates and professionals:

— Identification data: full name, age, nationality.

— Contact information: email address, phone number, LinkedIn profile and professional networks.

— Professional data: work history, education, skills, salary expectations, professional references and resume/CV.

— Process-generated data: interview and discovery call recordings and transcripts (with prior notice and consent), evaluation notes, scorecard results, and competency assessment results.

— Third-party data: when someone refers a candidate to us, or a client asks us to reach out to someone, we may receive that person’s name, phone number, or professional profile before they contact us directly. In such cases, we will aim to inform you when we first make contact.

We do not collect or process sensitive personal information. If we were to incidentally receive such information, it will be treated with strict confidentiality and not used for any purpose in the process.

By submitting your resume/CV, initiating a discovery call, or beginning any process with InDirectory Agency, you provide valid implicit consent for the processing of your data for the primary purposes described in this Policy.

b) Corporate clients and business contacts:

— Representative identification and contact data.

— Company information: industry, size, hiring needs, offered compensation ranges.

— Corporate documents: articles of incorporation, power of attorney, tax ID, or other documents required to formalize the service.

— Process-generated data: briefing call recordings (with prior notice and consent), job descriptions and project documents.

3. LEGAL BASIS FOR PROCESSING

We process your personal data based on:

— Consent: provided implicitly when initiating a process, or expressly when required.

— Contract performance: to fulfill obligations arising from our service relationship.

— Legitimate interests: for talent database maintenance and sending relevant market information, provided this does not override your fundamental rights.

— Legal obligations: when required by law, administrative authority, or court order.

4. HOW WE USE YOUR INFORMATION

a) Primary purposes (required for our services):

— Identifying, sourcing, and evaluating candidates for executive positions.

— Presenting candidate profiles to corporate clients.

— Managing the full recruitment and selection process.

— Communication and follow-up throughout the process.

— Fulfilling contractual and legal obligations (including audits, legal proceedings, or authority requirements).

— Contacting candidates for relevant positions while an active search process is ongoing.

b) Secondary purposes (you may opt out at any time):

— Including you in our talent database for future opportunities different from your current active process.

— Sending informational content about the labor market in Mexico and LATAM.

— Inviting you to events, conferences, or career coaching sessions.

5. ARTIFICIAL INTELLIGENCE AND TECHNOLOGY

To deliver a high-quality executive search service, we use specialized recruitment technology platforms and artificial intelligence tools. These may be used for:

— Call recording and transcription with AI (always with prior notice; you may decline and recordings will be deleted upon request).

— Candidate sourcing and prospecting through AI sourcing platforms.

— Profile analysis and comparison using generative AI tools.

— Searching and enriching publicly available professional information.

— Job posting and candidate discovery on employment platforms.

— Competency assessments and skills evaluations.

— Identity verification and digital document signing through certified platforms.

— Automation and optimization of service operational processes.

— Internal process documentation and candidate management.

Final decisions regarding candidates or hiring processes are never made solely by automated systems. A qualified human professional reviews, validates, and decides at every stage of the process.

6. HOW WE SHARE YOUR INFORMATION

Your personal data may be shared with:

— Corporate clients: Candidate data is shared with the client company only when the profile is relevant to the open position and with the candidate’s awareness.

— Technology providers: Platforms and tools used in service delivery, which are contractually bound to maintain the confidentiality and security of your data.

— Legal authorities: When required by law, court order, or administrative authority.

We do not sell, rent, or share your personal data with third parties for any commercial purpose or any purpose beyond those described in this Policy.

7. DATA RETENTION

We retain your personal data for a maximum period of 3 years from the conclusion of the process, or until you request its deletion, unless a legal obligation requires longer retention. You may request deletion of your data at any time by writing to contact@indirectoryagency.com

8. MINORS

Our services are directed exclusively to individuals 18 years of age or older. We do not intentionally collect or process personal data from minors.

9. SECURITY BREACH NOTIFICATION

In the event of a security breach that significantly affects your rights, we will notify you within the timeframes and in the manner established by applicable law, and will immediately implement the relevant corrective measures.

10. YOUR PRIVACY RIGHTS

Depending on your jurisdiction, you may have the right to:

— Access the personal data we hold about you.

— Request correction of inaccurate data.

— Request deletion of your data.

California residents: Under the California Consumer Privacy Act (CCPA), you have additional rights including the right to know, delete, and opt-out of the sale of personal information. We do not sell personal information.

We comply with applicable data protection legislation in each country where we operate, including Mexico’s LFPDPPP, the California Consumer Privacy Act (CCPA), and equivalent regulations in Argentina (Law 25.326), Colombia (Law 1581/2012), Brazil (LGPD), Chile (Law 19.628), Canada (PIPEDA), and the General Data Protection Regulation (GDPR) of the European Union for any processing of data belonging to European residents.
